Mutual Agreement Divorce
Three Steps When Both Parties Agree to Divorce:
📌 Signing the Divorce Application
A lawyer will draft a #divorce agreement based on your mutual terms. Once agreed upon, both parties can sign the document. Subsequently, the court will fix a hearing date upon filing of the petition
📌 Attendance in CourtÂ
Typically, it takes about a month to secure a hearing date. On the designated day, the judge will read the contents of the divorce agreement, ensuring both parties comprehend and consent to the terms.
⚠️ Note: It’s crucial to maintain respect in court proceedings. Any disrespect towards the court may result in repercussions. It’s essential to adhere to the court’s decorum and directives.
📌 Receiving the Divorce Certificate – Formalizing the Divorce
Following the hearing, you will receive the Decree Nisi Order, the initial document. Subsequently, you’ll obtain another document called Decree Absolute. Approximately three months later, the National Registration Department (JPN) will update your marital status from ‘married’ to ‘divorced.’
#During this period, it’s a contemplative phase, and you can retract your decision to divorce at any time.
If no retraction is made, after the three-month period, you’ll receive the divorce certificate, finalizing the divorce.
